About Spain Citizenship and Residency

Investment options available to acquire the citizenship and passport of Spain. 

Under the Residence by Investment program, individuals and their immediate family members can become residents of Spain (through a temporary residence permit) within less than a month. he Law offers the opportunity for non-EU citizens to obtain a Residence Permit by investing in Real Estate in Spain for a minimum value of EUR 500,000. A residence permit for 1 year is issued and can be renewed (for 2 years each time), provided that the real estate property is still owned by the applicant. Subject to general immigration rules and requirements, residents by investment can acquire permanent residence status after five years of continuous residence in Spain, and gain Spanish citizenship thereafter.

The Spanish Residency by Investment Program was launched in 2013. Investors do not need to take language and cultural exams. They are not required to spend time in Spain, and the laws allow investment property to be rented out. Investments under the program can be returned. To do this, you need to live in Spain for five years and obtain permanent residence status. After another five years of living in the country, you can apply for citizenship, but on the condition that you give up the first one. The minimum investment amount is EUR 500,000, investors may choose one of the options:

  • Investissement immobilier

Acquisition of real estate with a minimum value of EUR 500,000 should be done under this option.

An investor buys residential or commercial property in Spain. If they include family members in the application, the investment amount will not increase.

A property can be owned by the investor or the company, where the investor is a controlling shareholder and owns most of the shares. If the applicant buys commercial premises on behalf of the company, they can get a tax deduction and return the paid VAT of 21%.

The investor can purchase one or several properties for a total value of €500,000. The law does not have the rule to invest the entire amount in one property. The investor can rent out the real estate and sell it after obtaining permanent residence.

  • Shares or Business

– Investment of around EUR 1,000,000 in shares of Spanish companies can also be done.

– A statement of the investment from the Spanish Registrar of Investments of the Ministry of Economy and Competitiveness will be needed.

  • Government Bonds 

– Investment of around EUR 2,000,000 into government bonds is another option.

– A certificate from the Bank of Spain or another financial institution, stating you are the sole owner of the investment for a period of at least five years would be required.

  • Bank Deposit

– Funds transfer of EUR 1 million into a Spanish Bank Account can also be done.

– A certificate from the financial institution naming you as the sole owner of the bank deposit will be required.

Spanish Citizenship

Residents may apply for citizenship only in their 10th year of residence in Spain. There is no way to obtain Spanish Citizenship direct by investment. An investor can become a Spanish citizen by naturalization, get a residence permit in Spain by investment, move to the country, and get permanent residence in a few years, only then you can apply for citizenship.

Prospective Spanish citizens should comply with the following:

  • Before they apply for Spanish citizenship, they should live in Spain for the last 5 years as permanent residents.
  • They should provide documents proving they have been staying in the country legally.
  • They are expected to speak Spanish fluently.
  • They are also expected to know Spanish traditions, customs, and the way of life.
  • They should not be indebted to tax authorities or any other regulatory body.
  • They are expected to have a perfect reputation, they should have no convictions or violations of immigration laws on their record.
  • They should renounce the citizenship of their home country.

Spain Residency Requirements And Qualifications

The requirements and qualifications required to obtain Spain residency or citizenship are the following:

  • Applicants must confirm their financial solvency. They transfer to a Spanish bank account the sum that exceeds the annual minimum wage at least four times. In 2022, the minimum wage in Spain is €6,778.8 per year. Thus, an investor must transfer at least €27,000. Approximately €7,000 must be added for each dependent.
  • In the event that the investment is made by a legal entity, you must provide evidence that you own the majority of the rights over the company, and it is not domiciled in a tax haven according to Spanish legislation.
  • Spain only recognizes dual citizenship for nationals who have acquired Spanish nationality at birth. Naturalized citizens must renounce their previous nationality, except those from countries with which Spain has concluded a double-nationality agreement.

In the Documents collection stage and experienced immigration advisers will be checking all documents for compliance to ensure all requirements are met, including proof of investment documentation. The complete application for a residence permit along with all supporting documents confirming your investments will be then submitted to the Spanish government’s Ministry of Economy. 

Each application is vetted by the government through a thorough due diligence check, during which time submitted information is examined and verified.

Once the application is reviewed and approval is granted, you will be issued with a residence permit the government will issue a letter advising you of their decision.

Within a month after your biometrics have been submitted to one of the police stations in Spain, you will receive your residence card which is valid for 2 years and can be renewed every 5 years. Investors are eligible to attain permanent residency in 5 years, on the condition that they have resided in Spain for more than 4 years and 2 months during those 5 years. Citizenship can be applied for after 10 years if required. The residence card has to be collected personally, as a fingerprint check is undertaken during the collection.
